Infringement notice issued after Illegal dumping

Council has issued an infringement notice to a person after they were found responsible for the depositing of household waste upon the Howlong-Goombargana Road, at the front gate of the waste facility in Howlong.

Where breaches relating to the Protection of the Environment Operations Act 1997 (the POEO Act) are observed, Council has the option of issuing a Penalty Infringement Notice for minor breaches or alternatively, for more serious matters, presenting evidence to the local Court for determination.

In this case Council has determined that in lieu of taking the matter to Court, a Penalty Infringement Notice (fine) has been issued for the offence of ‘Transport etc waste to unlawful waste facility-class 1 officer Individual’ - $2000 fine, under the provisions of the POEO Act.
